Cury says TC is competent to override judicial decisions in July
jurist stated that the Constitutional Court is competent to set aside, as unconstitutional, court decisions. He said the legislature has referred to as either judicial decisions as "decisions? or "resolutions?, and only in the Criminal Procedure Code uses the term? resolution? to define the judicial decisions in more than 40 items, including 43, 57, 59, 68, 73, 74, 77, 79, 116, 122 and 123. As an example, Dr. Cury explained that decisions imposing coercive measures, the authorizing process and complex issues, which have access or revoke probation, acquitting or extinguish the criminal action, among others, are called rulings in the Code of Criminal Procedure.
